General conditions of use

ARTICLE 1: PREAMBLE

1.1.Definitions

GCU: Terms of Use, means this document.
Personal data: information relating to an identified or identifiable natural person.
Visitor: individual visiting the Site.
Site: refers to the ekinnox.com website and all its subdomains.
Company: means the company that publishes the Site.

1.3.Purpose
The purpose of these TOU is to define the conditions under which Visitors make use of
of the Site. Access to and use of the Site is subject to acceptance and compliance with these TOU.
While navigating the Site, regardless of the technical means of access and the terminals used,
you are presumed to be familiar with these TOU and accept the terms without reservation.
In case of contradiction between these TOU and any other document appearing on the site, the

ARTICLE 2: Access to the site

All Visitors with Internet access can access the Site free of charge 24/7 and 7/7. All
costs related to access to the Site, whether it be hardware, software or internet access fees are
solely at the Customer’s expense. He is solely responsible for the proper functioning of his

justification, particularly in the case of maintenance. The Company’s liability may not

ARTICLE 3: INTELLECTUAL PROPERTY RIGHTS

Trademarks, domain names, products, software, images, videos, texts or more
generally
all information subject to intellectual property rights are and remain the exclusive property of

ARTICLE 6: Compliance with laws and regulations

In order to facilitate access to other sites likely to be useful around the use of our
services, we insert hyperlinks on the Site. However, our responsibility cannot
be committed to a third-party site presenting contentious or inaccurate content to which you have
access via our Site. The Company has no means of controlling the contents of the sites
Third Parties. Similarly, its third party sites may contain hyperlinks to our Site. The
Company has no legal means to oppose this common practice and shall not
be held responsible for content from external sites.

As part of the evolution of the regulations and/or our services, we may be required to
to amend these TOU. In the event of a material change or special event, we
will communicate these changes to you by any means you have provided. In any condition
therefore, we invite you to consult this document regularly in order to
knowledge of any changes or updates made.

ARTICLE 9: APPLICABLE LAW AND CLAUSES

All clauses contained in these Terms will be subject to French law. All disputes
relating to the interpretation and execution of these general conditions of use is subject to the
french law.
In the absence of an amicable resolution, the dispute will be brought before the Commercial Court of Grasse (06).
