1. Introduction

Definitions

Terms and Conditions (T&Cs): Refers to these Terms and Conditions of Use. 
Personnal Data: Information relating to an identified or identifiable natural person. 
Visitor: Any natural person visiting the Site.
Site: Refers to the ekinnox.com website and its subdomains.
Company
: Refers to EKINNOX, the publisher of the Site.

Purpose

These T&Cs define the conditions of access and use of the Site by Visitors. By accessing the Site, you unconditionally accept these T&Cs. If you do not agree to these terms, please refrain from using the Site. 

In the event of any contradiction between these T&Cs and any other document on the Site, these T&Cs shall prevail.

2. Access to the site

The Site is freely accessible to any Visitor with an internet connection. Costs related to access to the Site, such as computer equipment, internet connection fees, and other related services, are the responsibility of the Visitor.

The Company strives to maintain continuous access to the Site but may interrupt access for maintenance, updates, or any other technical reason without prior notice. The Company cannot be held responsible for these interruptions or any consequences arising therefrom.

3. Intellectual property rights

All elements present on the Site (texts, images, videos, software, logos, etc.) are protected by copyright, trademarks, and other intellectual property rights. These elements are the exclusive property of the Company unless otherwise stated.

Any reproduction, representation, modification, publication, or adaptation of all or part of the elements of the Site, regardless of the means or process used, is prohibited without prior written authorization from the Company. Any unauthorized use of the Site or any of its elements will be considered an infringement and prosecuted in accordance with the provisions of Articles L.335-2 et seq. of the Intellectual Property Code.

4. Waiver and severability

The fact that the Company does not assert any of its rights at any given time, or tolerates a breach of any of the obligations under these T&Cs, shall not be interpreted as a waiver of such rights by the Company.

If any provision of these T&Cs is declared null and void, in whole or in part, the validity of the remaining provisions shall not be affected. In such a case, the invalid provision may be replaced by a valid provision that reflects the spirit and purpose of these T&Cs.

5. Protection of personal data

The Company respects the privacy of its users and commits to ensuring that the collection and processing of personal data are carried out in compliance with the General Data Protection Regulation (GDPR) and the amended Data Protection Act of January 6, 1978. 6. Compliance with laws and regulations

The Site must be used reasonably and in compliance with the applicable legal and regulatory provisions.

7. External links (inbound and outbound)

To facilitate access to other sites that may be useful in the context of using our services, we include hyperlinks on the Site. However, we cannot be held responsible for the content of any third-party site that may be accessed through our Site, especially if it contains controversial or inaccurate content. The Company has no control over third-party site content. Similarly, these third-party sites may contain hyperlinks to our Site. The Company has no legal means to oppose this common practice and cannot be held responsible for the content on external sites.

8. Modification of our Terms and Conditions

The Company reserves the right to modify these T&Cs at any time. In case of modification, the new T&Cs will be published on the Site with the update date. Visitors are advised to regularly consult the T&Cs to stay informed of any changes.

9. Governing law and clauses

All clauses of these T&Cs shall be governed by French law. Any dispute concerning the interpretation and execution of these Terms and Conditions of Use is subject to French law. 

In the absence of an amicable resolution, the dispute will be brought before the Commercial Court of Grasse (06).
